Terms & Conditions

These terms apply to all use of bacteriostaticwatereurope.com and to every order placed through it. By using the site or placing an order you agree to these terms, our Shipping Information, our Returns & Refunds Policy and our Privacy Policy. Read them before ordering. If you do not agree, do not use the site.

Section 1 – Who We Are

This website is operated by New Model Solutions Ltd, a private limited company registered in England (company number 17368614), with its registered office at 15F Empress Avenue, Ilford, IG1 3DE, England, trading as Bacteriostatic Water Europe. “We”, “us” and “our” refer to New Model Solutions Ltd. Contact: support@bacteriostaticwatereurope.com. Orders are fulfilled from our warehouse within the European Union.

Section 2 – Eligibility and Use of the Site

You must be at least 18 years old to order. You may not use the site or our products for any unlawful purpose or in breach of any law in your jurisdiction. We may suspend or terminate your access if you breach these terms.

Section 3 – Products and Research Use Only

All products sold on this site are supplied strictly for laboratory research. They are not medicinal products, are not medical devices and are not intended for human or veterinary use, diagnosis, treatment or consumption. Product descriptions are provided for research context only. You are responsible for ensuring that your purchase and use of the products complies with the laws applicable to you. We may limit sales of any product to any person, region or jurisdiction.

Section 4 – Orders and Contract Formation

The contract is concluded in English. When you place an order you make an offer to buy. We send an automatic order confirmation acknowledging receipt; this is not acceptance. The contract is formed when we dispatch the goods and send you the dispatch confirmation with tracking. We may decline or cancel any order before dispatch, including for stock errors, pricing errors, suspected fraud, or inability to verify payment or delivery details, in which case any amount paid is refunded in full. Before submitting an order you can review and correct it on the checkout page. We store the contract terms and send them to you by email with your order confirmation.

Section 5 – Prices and Payment

All prices are in euros and include VAT at the applicable rate. Shipping costs are shown at checkout before you confirm the order. Prices may change at any time, but changes do not affect orders already accepted. Payment is taken at checkout by the methods displayed there. If a product is listed at an obviously incorrect price we will contact you before dispatch and you may cancel for a full refund.

Section 6 – Delivery

We deliver to the 27 EU member states only. Delivery times, rates and cutoffs are set out on our Shipping Information page and are estimates, not guarantees. Risk in the goods passes to you when you or a person nominated by you takes physical possession of them. Ownership passes on full payment.

Section 7 – Right of Withdrawal and Returns

If you are a consumer in the EU you have the right to cancel your order within 14 days of receipt without giving a reason, subject to the sealed-goods exception for products opened after delivery. Full details, the exceptions, and how to exercise the right are in our Returns & Refunds Policy, which forms part of these terms.

Section 8 – Legal Guarantee of Conformity

Consumers in the EU are entitled to a two-year legal guarantee of conformity from delivery. If goods are defective or not as described, you may request repair, replacement, a price reduction or a refund as provided by the consumer law of your country of residence. Our Perfect Order guarantee is in addition to these rights and does not replace them.

Section 9 – Accuracy of Information

We take care to ensure information on the site is accurate, but we do not guarantee it is complete, current or error-free. General information on the site is not professional, scientific or medical advice and is not a substitute for your own assessment.

Section 10 – Third-Party Links

Links to third-party websites are provided for convenience. We do not control them and are not responsible for their content, products or services.

Section 11 – User Submissions

If you send us reviews, feedback, suggestions or other material, you grant us a non-exclusive, royalty-free licence to use, edit and publish it in any medium. You confirm you have the right to submit it and that it does not infringe any third-party rights.

Section 12 – Personal Data

We process personal data in accordance with our Privacy Policy and the General Data Protection Regulation.

Section 13 – Prohibited Uses

You may not use the site or its content for any unlawful purpose; to infringe our or others’ intellectual property; to upload malicious code or interfere with the site’s operation; to harass, abuse or discriminate against anyone; or to submit false or misleading information. Any communication referencing the use of our products for human or animal consumption is prohibited and will result in cancellation of pending orders, loss of the Perfect Order guarantee and a permanent ban. Your statutory rights are unaffected.

Section 14 – Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or for any liability that cannot be excluded under applicable law, including your statutory rights as a consumer.

Subject to that, we are not liable for any loss arising from your use of products other than for laboratory research, for indirect or consequential loss, for loss of profit, business or data, or for any failure caused by events outside our reasonable control. Our total liability to you in connection with any order is limited to the amount you paid for that order. We do not guarantee that the site will be uninterrupted, secure or error-free.

Section 15 – Indemnification

You agree to indemnify New Model Solutions Ltd and its officers, employees and affiliates against any claim, loss or cost, including reasonable legal fees, arising from your breach of these terms or your unlawful use of the products. This does not apply to consumers to the extent prohibited by the law of your country of residence.

Section 16 – Changes to These Terms

We may update these terms at any time. The version in force when you place an order applies to that order.

Section 17 – Governing Law and Disputes

These terms are governed by the laws of England and Wales. If you are a consumer resident in the EU, you also benefit from the mandatory consumer protection provisions of the law of your country of residence, and nothing in this clause deprives you of them. You may bring proceedings in the courts of your country of residence. We will attempt to resolve any dispute directly with you first; contact support@bacteriostaticwatereurope.com.

Section 18 – Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions continue in full effect.
